Court denies injunction

 

MILFORD:

The Conashaugh Lakes Community will not be required to increase the weight limits on its roads to accommodate builders’ equipment.

Nikles Realty Inc., Ed Nikles Custom Builder Inc. and the Pike County Builders Association were all plaintiff’s in the court hearing requesting an injunction against Conashaugh Lakes Community Association. Conashaugh has a “spring thaw” weight limit of 10,000 pounds on construction vehicles entering the community.

In a July 16 decision set down in the Pike County Court of Common Pleas, Judge Joseph Kameen denied the plaintiff’s petition for preliminary injunction.

Nikles claimed that Conashaugh’s “spring thaw ban” of trucks over 10,000 pounds, as written in the rules and regulations of the community, would cause delays in construction, loss of work and other costs which could not be calculated. Nikles filed an injunction against Conashaugh last March claiming this restriction violated the Uniform Planned Community Association Act 180 of 1997, which states a 20,000 pound weight limit for that same period should be in place.

Conashaugh Lakes Community Association Board President John Crerand testified that Conashaugh’s weight limit ban was put into place in 1995, prior to the 1997 UPCA weight limit restriction. Crerand also showed photographs of the damage caused to the roads within the community by overweight trucks.

In the decision made by Kameen, he noted that all association members, home and/or property owners must abide by the community’s bylaws which were in effect in 1986. He also noted that members must also, as stated in the bylaws, obey at all times the rules and regulations of the community. Since those rules limit the spring thaw weight limit to 10,000 pounds for members, a contractor’s rights of access should not exceed that of owners.

Kameen ruled that the injunction sought by Nikles would do more harm than good and therefore the injunction was denied.

Rock Hill has given the CLCA office a number of letters for us to send to our members concerning well level testing.  If you received this letter PLEASE agree to have your well monitored it is very important to determine if Rock Hill deep wells will drop the water level so much that wells in CLCA could go dry.

Our New Neighbors to the Northwest!

 

Rock Hill Estates is our new neighbor and in some cases growth is good. The new

developement will have some similarities to CLCA but there is one big difference.

They will have central water from deep wells within the development as we

understand there will be 5 deep wells to service the 200 lots and homes projected.

The depth of the two wells are 425 and 505 and the earlier report of 5 deep well was not undertaken.

 

The question is what will the deep wells do to, or how will they effect the homes within CLCA along the Northwest edge or the hole of CLCA? CLCA wells are drilled not as deep as the projected deep wells.

Up Date 5/10/06. Our Attorney and a CLCA Officer attended the Dingman Township Planning Commission meeting on 5/10 to maintain a CLCA presence for future planning concerning deep wells.

Alert 2.  

We have received a complaint regarding  DOOR TO DOOR SOLICITING for the purpose of selling boxed meats.             The complaint referenced the poor quality and what appeared the random costs from customer to customer for                the same items.  The complainant wanted to warn other of this situation. 

CLCA Rules and Regulation prohibit any Door to Door Soliciting.  Members should contact Security as soon as      possible @ 686 1130 or the Office @ 686 4000 and report the violation.

Alert 1  

We have received phone calls to the office that the Pennsylvania State Police  (PSP) have called members to                   gain access into the Community.  This in not true.  If you did not call the PSP there is no reason for a call to                your home for access.  The PSP have codes to enter CLCA when needed.  If this happens to you please report the       incident to the office at 686 4000 as soon as possible.
